PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF SALE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS. YOU MUST AGREE TO THESE TERMS BEFORE PROCEEDING TO PAY FOR YOUR PRODUCT.

Universal Pedagogia English School France offers a satisfied or money-back guarantee.

Thus, in case of dissatisfaction, you can request a refund for the product within 35 days of the purchase date. To obtain a product refund (excluding shipping costs), you must explain why it was unsuitable and return it in the same condition as when purchased (clean item, mint condition, etc.). To do this, simply:

  1. Download and complete the money-back guarantee form below

  2. Return the product and the completed form to us by recorded delivery** (within 35 days of the product purchase date).

 

You must also include your bank details with your request so that the refund can be processed as quickly as possible. Refunds will be processed within a maximum of 6 days of product receipt, after verification of its conformity (clean item, mint condition, etc.). We do not offer exchanges.

 

Return shipping costs will be the buyer's responsibility.

**If the package is lost by the Post Office and you do not have proof of delivery, we will not be able to refund you.

Article 1: SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter "GTC") apply to any order placed remotely by a physical person with legal capacity and acting in a personal capacity as a consumer (and not as a professional) with Universal Pedagogia English School France, whose registered office is located at 4 Place du Général de Gaulle, 07120 RUOMS, via the website accessible at the following address: www.upenglish-centrederecherche.fr

The applicable GTC are those appearing on the website at the time of your order and imply full, unreserved, and unconditional acceptance of the current GTC. We reserve the right to modify the GTC at any time by publishing a new version on the Website.

The website upenglish-centrederecherche.fr is freely accessible to all customers. The purchase of a product or service implies acceptance by the customer of these Terms and Conditions in their entirety, and the customer thereby acknowledges having fully read and understood them. This acceptance may consist, for example, of the customer ticking the box corresponding to the sentence accepting these Terms and Conditions, such as "I accept the general terms and conditions." Ticking this box will be deemed to have the same value as a handwritten signature by the customer.

If the customer is a minor or does not have this legal capacity, they declare that they have the authorisation of a guardian, curator, or legal representative.

The customer acknowledges the evidentiary value of Universal Predagogia English School France's automatic registration systems and, unless they provide proof to the contrary, they waive the right to contest them in the event of a dispute. ​

Article 2: MARKETING RIGHTS

The marketing of Quick English© is reserved exclusively for Universal Pedagogia English School France, owner of the trademark and all rights. Any dispute relating to unauthorised marketing is governed by The Business and Property Courts, London, United Kingdom.

Article 3: INTELLECTUAL PROPERTY

The law of 11th March, 1957 prohibits copies or reproductions intended for collective use. Any representation or reproduction, in whole or in part, by any means whatsoever, without the consent of the author or their successors in title, is unlawful (Article L. 122-4 of the Intellectual Property Code). Such representation or reproduction by any means whatsoever constitutes an infringement punishable under Article L. 335-2 of the Intellectual Property Code.

Registered with a bailiff (09/17/2021) and with the French National Institute of Industrial Property (2019-4865 designs and models on 11/09/2019) i.e.: layout with literal interlinear translation of the target language, specifically intended for language learning©.

Any dispute relating to the unauthorised use of this model and design shall be submitted, failing amicable settlement, to the Lyon Judicial Court and the Chancery Division of the High Court, London, United Kingdom.

Article 4: PRODUCT INFORMATION

The Products offered are those listed in the catalogue published on the upenglish-centrederecherche.fr website. Each product is accompanied by a description prepared by Universal Pedagogia English School France. The product images in the catalogue accurately reflect the products offered but do not constitute a contractual commitment, as they cannot guarantee perfect similarity with the physical products.

 

Article 5: DESCRIPTION OF THE PURCHASING PROCESS

The "Shopping Cart" is defined below as the intangible object containing all the products selected by the customer of the upenglish-centrederecherche.fr website for purchase by clicking on these elements. To place an order, the customer selects the product(s) they wish to order by adding them to their "Shopping Cart," the contents of which can be modified at any time.

Once the customer considers that they have selected and added all the products they wish to purchase to their cart, they will have the option to confirm their order by clicking on the button provided for this purpose. They will then be redirected to a summary page where they will be informed of the number and characteristics of the products ordered, as well as their unit price.

The customer will then be redirected to a page where they must complete the order form. In this case, they will be required to provide certain personal information necessary for the order to be processed.

Once the customer has completed the form, they will then be invited to make their payment using the payment methods listed in the section of these Terms and Conditions relating to payment methods.

All orders placed on the upenglish-centrederecherche.fr website must be duly completed and must include this necessary information. The customer may make changes, corrections, additions, or cancel the order up until its validation.

 

To validate their order, customers must tick the box to accept the General Terms and Conditions of Use and General Terms and Conditions of Sale (e.g., "I accept the General Terms and Conditions"), then tick the box to accept the Privacy Policy (e.g., "I accept the Privacy Policy"). Finally, the customer can click the validation button.

 

After a few moments, the customer will receive an order confirmation email, reminding them of the order contents and price.

*Products sold remain the property of Universal Pedagogia English School France until full payment.

Article 6: PRICE INFORMATION

The price of the products (excluding delivery costs) is as indicated on the corresponding product sheet, available on the website www.upenglish-centrederecherche.fr. We reserve the right to revise the price of our products in accordance with applicable legislation. The products you order will be invoiced based on the price in effect on the website at the time your order is confirmed and are inclusive of VAT (VAT is not applicable: Article 293 B of the French General Tax Code).

Article 7: PAYMENT METHODS

The Customer may place an order on this website and may pay by credit card. Payments by credit card are made using secure transactions provided by our online payment platform provider (Stripe). Payments by credit card are made in full at the time of ordering, and in euros only. After your payment has been validated by our online payment platform provider (Stripe), you will be automatically transferred back to our website.

7.1 Bank Cards: The following cards are accepted: CB, VISA, MASTERCARD, AMERICAN EXPRESS, CHINA UNION PAY, JCB, DINERS, VISA ELECTRON, DISCOVER, and MAESTRO. All data entered during payment by credit card is immediately encrypted using SSL protocol and stored on our banking partner's server. No confidential payment data is stored by Universal Pedagogia English School France. This information is accessible only through our online payment platform provider: Stripe.

7.2 PayPal :This secure payment method allows you to quickly pay for your items without sharing your banking information with sellers. All you need to do is provide your bank details when creating your PayPal account. They are then encrypted and secured once and for all.

If you already have a PayPal account, you can use it on our website to pay for your purchases quickly and securely. If you don't have a PayPal account, you can still choose this payment method. At checkout, you will be directed to a PayPal page where you can pay by credit card.

Article 8: PAYMENT METHODS

Orders are payable in euros including VAT, plus shipping costs. The buyer will be responsible for any bank charges (including in the case of a refund). In the event of non-payment or partial payment of any amount owed by the buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the website, including in the case of previous orders, Universal Pedagogia English School France reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution.

Article 9: SHIPPING AND DELIVERY

When you place your order, we may offer you different delivery methods, depending in particular on the number of books ordered and your delivery address. Delivery conditions, fees, and delivery times vary depending on the delivery method you choose.

You will be informed, when you place your order, of the available delivery method(s) as well as the applicable delivery times and rates. We particularly recommend that you pay attention to these details before confirming your order.

9.1 Delivery Methods, Fees, and Dates

We offer several delivery methods depending on the quantity of items purchased and your location.

Since 7th October 2023, regulations have imposed a minimum charge for deliveries of new books. This regulation applies to all customers and concerns all deliveries in France, whether made to your home or to a pick-up point:

  • 3€ for an order containing less than 35€ of new books ( mainland France)

  • Free shipping for an order containing 35€ or more of new books (mainland France)

For Belgium, Switzerland, and Luxembourg, the delivery costs are:

 

  • 7.50€ for an order under 50€

  • Free shipping for an order over 50€

 

Delivery costs will be indicated at the time of ordering.

 

Delivery to certain areas may incur an additional charge. In the event of delivery of a product outside of France (mainland France), Belgium, Switzerland, and Luxembourg, the customer declares themselves the importer of the product and accepts that in such cases, the seller (Universal Pedagogia English School France) may be materially unable to provide accurate information on the total amount of fees relating to customs duties and formalities or import taxes applicable in the country where delivery of the product is requested.

 

Our products are shipped within 48 hours (excluding Sundays and public holidays).

 

Delivery times are provided for informational purposes only.

9.2 Delayed Delivery

In the event of a delay in delivery, we will inform you. You can also report the delivery delay yourself by contacting us via our contact form.

We undertake to take all necessary steps to determine the cause of the delay and find an appropriate solution to ensure the effective delivery of the ordered products as quickly as possible.

Unless otherwise stated on the website during the ordering process or in the description of the ordered products, we undertake in all cases to deliver the product(s) to you within a maximum of 30 days.

Article 10: RECEIPT

10.1 Missing Product

Upon receipt of your order, you must check that it is complete.

If you notice that a product is missing from your package, please contact us via our website: www.upenglish-centrederecherche.fr or directly via our contact form within 24 hours of receiving your order so that we can process your complaint as quickly as possible.

10.2 Damaged Delivered Products

You may refuse a package upon delivery if you notice an anomaly (damage, product missing from the delivery note, damaged package, etc.); you must report the anomaly and note it on the delivery note, in the form of handwritten reservations accompanied by your signature. To exercise your right of refusal, you must open the damaged or defective package(s) in the presence of the carrier and have them collect the damaged goods. If you fail to comply with these instructions, you will not be able to exercise your right of refusal, and we will not be held liable.

If the package is returned to us by the Post Office or other postal service providers, we will contact you upon receipt of the returned package to ask you what to do with your order.

Article 11: WITHDRAWAL

11.1 Principle

The right of withdrawal allows you to return your item and receive a refund without having to provide a reason for return.

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, you have 14 business days from the day after receipt of the last product in your order to exercise your right of withdrawal without having to provide a reason or pay a penalty.

If the 14 business day period expires on a Saturday, Sunday, or a public holiday, it is extended until the next business day.

The return of products in perfect condition for resale is your responsibility and at your expense.

 

Any damage to the products during this period will invalidate your right of withdrawal.

In accordance with the provisions of Article L. 221-23 of the French Consumer Code, you are responsible for the handling of the goods and any depreciation in their value during the withdrawal period. As such, we reserve the right to hold you liable for any depreciation in the value of products returned pursuant to the exercise of your right of withdrawal, resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of these products. Any visible trace on any product, such as dirt, scratches, or a torn portion of the product (but not limited to), will be considered a depreciation of the product, which will then become unfit for sale, and we reserve the right to charge the customer the financial cost related to this depreciation.

If we do not receive your product or provide proof of shipment within this timeframe, we reserve the right to defer your refund until the day we receive your product.

The refund will be issued by Universal Pedagogia English School France within a maximum of 10 days, subject to receipt of the items at our logistics center, directly to the account debited during the initial payment of the order. In the event of a cancellation, the refundable amount corresponds to the returned items and their original shipping costs. However, if a more expensive delivery method than the standard delivery method was chosen, the standard delivery method will be refunded, in accordance with Article L121-21-4 of the French Consumer Code. Return costs are the buyer's responsibility.

11.2 Terms and Conditions

To exercise your right of withdrawal, you must download and complete the cancellation form below. Then, you must:

  • Repackage the items in their original packaging. If you no longer have it, please take the utmost care when packaging your return;

  • Include a copy of the withdrawal form, the corresponding invoice, and your bank details (to process the refund) in the package;

  • Seal the package;

  • Write the address provided on the withdrawal form on the package;

  • Send your package through the Post Office*

The refund will be issued within a maximum of 6 days from receipt of the item and after verification of its conformity (clean item, mint condition, etc.). We do not offer exchanges.

Return shipping costs will be the buyer's responsibility.

 

*We recommend using tracked delivery and retaining the number. Indeed, if the Post Office loses the package and you do not have proof of deposit, we would not be able to reimburse you.

Article 13: CREATING A CUSTOMER ACCOUNT

 

Creating a "customer account" is not required for any customer wishing to place an order on the upenglish-centrederecherche.fr website.

Customers who register on the website can access it by logging in using their login details (email address specified during registration and password). Customers are solely responsible for protecting their chosen password. Customers are encouraged to use complex passwords. If they forget their password, they can generate a new one. This password guarantees the confidentiality of the information contained in their "My Account" section, and customers are therefore prohibited from transmitting or sharing it with any third party. Otherwise, Universal Pedagogia English School France cannot be held responsible for unauthorised access to a customer's account.

The customer account allows customers to view all their orders placed on the upenglish-centrederecherche.fr website. If the data contained in the customer account section were to disappear due to a technical failure or force majeure, Universal Pedagogia English School France cannot be held liable, as this information has no probative value and is solely for informational purposes. The customer account pages are freely printable by the customer holding the account in question but do not constitute proof; they are solely for informational purposes intended to ensure the efficient management of their orders or contributions.

Each customer is free to close their account on the website. To do so, simply send us a message via our contact form indicating that you wish to delete your account. Your data will then not be recoverable.

Universal Pedagogia English School France reserves the exclusive right to delete the account of any customer who has violated these Terms and Conditions. Such deletion will not constitute damages for the customer, who will not be entitled to any compensation as a result. This exclusion does not preclude Universal Pedagogia English School France from taking legal action against the client, when the facts warrant it.

Article 14: WARRANTIES

14.1 Legal Warranties

We are liable for defects in goods conformity of with the contract under the conditions of Article L. 217-3 et seq. of the French Consumer Code and for hidden defects in the item sold under the conditions set out in Articles 1641 et seq. of the French Civil Code. Regarding the warranty against hidden defects, the consumer may decide to invoke this warranty within the meaning of Article 1641 of the French Civil Code and, in this case, may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.

Any defective or non-compliant item will be returned and refunded; we do not offer exchanges.

The refund will be made within a maximum of 10 days directly to the account debited during the initial payment of the order, subject to receipt of the items at our Training & Researcg centre.

Article 15: LIABILITY

Universal Pedagogia English School France shall not be held liable for non-performance of the contract due to the occurrence of a force majeure event. Regarding the products purchased, Universal Pedagogia English School France shall not be liable for any indirect damages resulting from this contract, including operating losses, loss of profits, damages, or expenses that may arise.

 

The selection and purchase of a product are the sole responsibility of the customer. The total or partial inability to use the products, particularly due to hardware incompatibility, shall not give rise to any compensation, refund, or liability on the part of Universal Pedagogia English School France, except in the case of a proven hidden defect, non-conformity, or defectiveness, or in the case of exercising the right of withdrawal, if applicable, i.e. if the customer is not a consumer and the contract entered into to purchase the product allows for withdrawal, in accordance with Article L 221-18 et seq. of the French Consumer Code.

The customer expressly acknowledges that they use the upenglish-centrederecherche.fr website at their own risk and under their sole responsibility. The upenglish-centrederecherche.fr website provides information to the customer for informational purposes only, with imperfections, errors, omissions, inaccuracies, and other ambiguities that may exist. In any event, upenglish-centrederecherche.fr shall not be held liable under any circumstances for:

  • any direct or indirect damage, particularly with regard to loss of profits, loss of earnings, loss of customers, or loss of data, which may result, among other things, from the use of the site, or conversely, from the inability to use it;

  • malfunction, unavailability of access, misuse, improper configuration of the customer's computer, or the use of a browser that is not commonly used by the customer.

 

The photographs and visuals of the products presented on the upenglish-centrederecherche.fr website are not contractually binding. Universal Pedagogia English School France cannot be held liable if the characteristics of the products differ from the visuals on the website or if the latter are incorrect or incomplete.

Article 16 : FORCE MAJEURE

Universal Pedagogia English School France shall not be held liable for the failure to fulfill any of its obligations under the sales contract if such failure is due to the occurrence of a force majeure event.

Article 17: PERSONAL DATA

Universal Pedagogia English School France undertakes to maintain the confidentiality of the information provided by the purchaser, which the purchaser may be required to provide for the use of certain services. All information concerning the purchaser is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning them. Article 18: SEVERABILITY OF CLAUSES

 

If any provision of these Terms and Conditions is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

These Terms and Conditions supersede all prior or contemporaneous agreements, whether written or oral. These Terms and Conditions are not assignable, transferable, or sublicensable by the customer.

A printed version of these Terms and Conditions and all notices given in electronic form may be requested in judicial or administrative proceedings relating to these Terms and Conditions. The parties agree that all correspondence relating to these Terms and Conditions must be written in French.

Article 19: DISPUTES, MEDIATION, and APPLICABLE LAW

19.1 For any complaints, our Customer Service team is available via our website: www.upenglish-centrederecherche.fr.

19.2 Unless otherwise provided for by mandatory provisions such as those arising from EC Regulation No. 593/2008 of 17th June, 2008 on the law applicable to contractual obligations (Rome I), these General Terms and Conditions are subject to French law. In the event of a dispute, and after the failure of any attempt to find an amicable solution, the French courts shall have exclusive jurisdiction to hear the dispute.

In the event that one or more clauses of these General Terms and Conditions become invalid following a change in legislation or by court decision, this shall in no way affect the validity of the other clauses, which shall remain applicable.

19.3 In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, the Buyer is informed of the possibility of resorting to a conventional mediation procedure by sending a written complaint to the Européenne online dispute resolution (ODR) platform chosen by us.
